If you buy as an individual outside your business or profession, you are a consumer and benefit from the specific rights granted by Slovak consumer law. Provisions intended for consumers do not apply to purchases made in the course of business.
2. Product information
The main characteristics, dimensions, materials, availability and price of the goods are shown on the relevant product page. The goods are intended to be used in the ways described on the product page and in the supplied instructions. Images are illustrative; colours may differ slightly due to screen settings and the natural properties of materials. Reasonable variations do not limit your rights where the goods fail to meet the agreed or statutory requirements.
3. Orders and formation of the contract
Before submitting an order, you can review and correct the information entered. By submitting the order using a button that clearly indicates an obligation to pay, you place a binding order. We will send you an electronic acknowledgement after receiving it. The sales contract is formed when we confirm that we have accepted the order for fulfilment. If an automated message only confirms technical receipt of the order, it does not yet constitute acceptance.
We store the contract electronically for at least as long as necessary to perform it and meet our legal obligations. Your order and related documents may also be available in your customer account, where that feature is available. The contract is concluded in Slovak. This English version is a translation; your mandatory consumer rights are not affected.
We may decline an order in particular where goods are unavailable, there is an obvious pricing or data error, delivery is not possible or there is a reasonable suspicion of fraud. We will explain the reason and promptly refund any payment already received.
4. Prices and payment
Prices are shown in euros and include VAT unless expressly stated otherwise. Delivery charges and any other fees are displayed before the order is submitted. You may pay using the methods offered at checkout. A payment service provider may process the payment under its security terms.
We do not have to accept an order at an obviously incorrect price. Before a contract is formed, we will notify you of the error and give you the option to order at the correct price. If payment has already been received and we do not accept the order, we will refund it promptly.
5. Delivery
We deliver to the addresses and by the methods available at checkout; the store is currently intended for delivery within Slovakia. An estimated delivery time is shown with the order. Unless otherwise agreed, we will deliver without undue delay and no later than 30 days after the contract is formed.
The risk of damage to or loss of the goods passes to a consumer only when the consumer or a third party appointed by them, other than the carrier, receives the goods. If delivery fails because of incorrect information or failure to take delivery, we may charge only reasonable costs actually incurred for redelivery or return of the parcel.
6. Cancelling before dispatch
To cancel an order before dispatch, contact us as soon as possible at info@moiproduct.com or use the available feature in your customer account. If the goods have already been dispatched, you may use the right of withdrawal described below.
7. Consumer right of withdrawal
A consumer may withdraw from the contract without giving a reason within 14 days from the day on which the consumer, or a third party appointed by the consumer other than the carrier, receives the goods. For goods from one order delivered separately, the period runs from receipt of the final item or part.
To exercise the right, send us an unequivocal statement by email or post before the period expires, or use the Withdraw from the contract function on our website. We will promptly acknowledge by email a withdrawal submitted through that function.
Send or hand the goods back no later than 14 days after withdrawing to moiproduct, s. r. o., Protifašistických bojovníkov 3947/7, 080 01 Prešov, Slovakia. The consumer bears the direct cost of returning the goods unless we expressly state that we will bear it.
Within 14 days of receiving the withdrawal notice, we will refund all payments received under the contract, including the cost of the least expensive standard delivery method we offered. We do not refund any additional cost caused by the consumer choosing a more expensive delivery method. We will refund using the original payment method unless otherwise agreed and provided that this does not cause you additional fees. We may withhold the refund until we receive the goods or you provide evidence that they have been sent back, whichever occurs first.
The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Opening the packaging or reasonably testing or assembling ordinary, non-personalised goods does not by itself exclude the right of withdrawal. Original packaging is not a condition of withdrawal, although we recommend using it for safe transport.
The right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised goods. This exception applies only where the particular goods are genuinely personalised or made to individually specified requirements—not merely because they are furniture or have been assembled.
8. Defects and complaints
We are liable for defects that the goods have on delivery and that become apparent within two years of delivery, unless the law provides for a longer period. Notify us of a defect within two months of discovering it and no later than the statutory deadline. You can make a complaint by email, post or in person at our address.
Subject to the statutory conditions, a consumer may choose repair or replacement unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative. In the circumstances provided by law, the consumer is entitled to an appropriate price reduction or to withdraw from the contract. There is no right to withdraw for a negligible defect.
Detailed instructions and current information are available on our Complaints and warranty page. Nothing in these Terms limits a consumer's statutory rights.
9. Use and care of the goods
Use the goods for their intended purpose and in accordance with the product information, instructions and safety warnings. Normal wear and tear, damage caused by misuse, neglected maintenance or modification contrary to the instructions is not a defect for which the seller is liable. This does not apply where the damage or defect was caused by inadequate or incorrect instructions or another matter for which we are responsible.
10. Website content and intellectual property
Text, photographs, design, trade marks and other website content are protected by applicable rights. They may not be used without permission beyond personal, non-commercial use or statutory exceptions. This section does not restrict the use of information needed to exercise your rights.
11. Personal data
Information on how we process personal data is available in our Privacy Policy. Processing beyond what is necessary to enter into and perform the contract or meet legal obligations is not a condition of purchase. Marketing consent is separate and optional.
12. Complaints and alternative dispute resolution
If you are dissatisfied, please contact us first at info@moiproduct.com. We will respond to a request for redress without undue delay.
If we reject your request or do not respond within 30 days, you may refer the dispute to an authorised alternative dispute resolution entity. For consumer disputes involving our online store, this is principally the Slovak Trade Inspection, Central Inspectorate, Department of International Relations and Alternative Dispute Resolution for Consumer Disputes, Bajkalská 21/A, P. O. BOX 29, 827 99 Bratislava 27, email: ars@soi.sk or adr@soi.sk, website: www.soi.sk. The Slovak Ministry of Economy maintains the list of all authorised alternative dispute resolution entities.
The supervisory authority for the seller's registered office is the Inspectorate of the Slovak Trade Inspection in Prešov for the Prešov Region, Obrancov mieru 6, 080 01 Prešov 1.
13. Final provisions
The contract is governed by Slovak law. If a consumer is protected by mandatory provisions of another country's law, the choice of Slovak law does not deprive the consumer of that protection.
We may amend these Terms for the future. The version in effect when an order is submitted applies to that order; a later amendment does not change an existing contract without the parties' consent. If any provision is invalid, the remaining provisions remain effective and the relevant statutory rule applies in place of the invalid provision.
